Please read the regulations below carefully in order to use without limitation agnieszka-niechcial.com/en Website.
The Regulations define the principles of providing a comprehensive service by the Author to Clients.

Website agnieszka-niechcial.com/en is owned by WRECZ Ltd, represented by Agnieszka Niechciał (Author). All Content (paintings, illustrations, photography, graphic works, drawings – patterns available in digital form or on physical media) belongs to WRECZ Ltd and is protected by copyright and provisions of Polish and European Civil Code. This also applies to website articles and newsletters. If external content is used on the Website it is clearly stated.
Some of the referring links on the site are affiliate links to external websites.
The Author excludes the possibility of copying, duplicating, modifying, distributing or other forms of commercial use of materials owned by the Author without the prior written consent of the Author.

A Client who makes a purchase in the store on the website: agnieszka-niechcial.com has the option of:

1. Purchasing a ready-made decorative pattern in the form of a digital file.
2. Obtaining a comprehensive service, where the Author performs the ordered service on behalf of the Client, who pays for the decorative pattern available on the website or ordered in a unique, one-time form via a separate message and at the same time commissions the Author to make items with the selected pattern. The Author buys the materials needed to perform the service, produces a given item for the Client, completes and sends the performed service to the specified address. All materials used to perform the service are included in the price of the pattern.

The Author has the right, in his sole discretion, to amend the terms and conditions of this Agreement, in whole or in part, at any time. All changes shall be effective immediately upon Client notification and publication of such changes on the Website. Your continued use of the Website after the effectiveness of such changes and notice constitutes your acknowledgement and acceptance of the terms and conditions of this Agreement. If you do not agree to be bound by the terms and conditions of this Agreement as so amended, you may not use the Website.

AS CLIENT YOU CONFIRM, ACKNOWLEDGE AND WARRANT THAT:

1. You are at least 18 years of age and have the right to enter into this Agreement.
2. You shall not use the Content in any way that is not permitted by this Agreement.
3. Your use of the Content will not violate any applicable law of any country or state or other governmental entity.
4. The information you provide to Website agnieszka-niechcial.com/en.
5. You acknowledge that all passwords to your account on agnieszka-niechcial.com/en Website will be kept confidential. You may not share or disclose password or login information to any other User or to third party, unless Author agrees otherwise.
6. You may not in any way act to the detriment of agnieszka-niechcial.com/en Website.

In case you breach any conditions of this Agreement Author reserves the right to terminate the Agreement immediately, without notice and to claim compensation. License, being a part of this Agreement automatically expires without notice, if you, the Client, do not comply with the provisions of this Agreement. Upon termination of this Agreement you shall destroy all the materials which you have received from agnieszka-niechcial.com/en Website, their copies and all documents.

You agree that in no case Author shall be liable for any damages whether indirect, collateral, special or consequential, whether predictable or unpredictable arising from liability claims, lost profits claims, loss of use claims, even if Author has known about the possibilities of damage or third party’s claims.
You acknowledge that you have read, understood this Agreement and that you have agreed to be bound by the Terms and Conditions of this Agreement. You also agree that this Agreement is a legal act confirming legal relationship between You as Client and WRECZ Ltd, represented by Agnieszka Niechciał as the Author.

This Agreement was originally composed in Polish and translated into English. In case of any inaccuracy Polish version takes precedence.
In matters not regulated by this Agreement provisions of Polish and European Civil Code and copyright shall apply.

ORDERS

The purchased digital file will be ready for download immediately after the payment is posted.
Author guarantees that Content downloaded from agnieszka-niechcial.com/en Website is free of any defects but does not claim it will fulfill all your criteria, neither that access to the Website will be uninterrupted and flawless. Author allows the same Client to download the purchased Content twice within 90 days from the date of purchase.
User is fully responsible for the quality and use of the downloaded Content.

Orders physical products can be placed on the Serwis and are not binding until WRECZ Ltd has confirmed the order by issuing an order confirmation. Once you have placed your order we will send you a preliminary confirmation via email. We operate Monday – Saturday except for public holidays.
If your order concerns a physical product (transferring the design to a physical medium) – the delivery date is determined individually. Once your order has been shipped we will send you the final confirmation.
When you place an order, all data is encoded to and from the website by SSL (Secure Socet Layers).

PAYMENT & SHIPPING

We accept payment with PayPal, credit cards and bank transfer.
At the customer’s request I issue VAT invoices.

For all countries outside the EU, local charges such as import duties and/or sales tax may apply. These charges are at your expense and we recommend you to contact your local customs office for more information.

Our shipments are send by courier. We strive to ship as soon as possible. WRECZ Ltd cannot be held responsible if is delayed carrier.
If you do not pick up your package in the selected package shop in time or if failed to deliver at the address, we will receive your package back and all additional costs will be held at your expense.

Delivery times vary depending on the country and customs issues and are therefore only indicative.
The shipping is 2 days from posting a payment for order, when the delivery address is inside Europe 5 – 12 days and 2 – 4 weeks when outsite Europe.

Delivery in Poland is 5 euro.
Free delivery to Poland is from the order amount of 95 euro.
Shipping to Europe is 16,50 euro.
Shipping worldwide (outside Europe) is 35,50 euro.

RETURN POLICY

Digital products – whether standalone, by themselves or on physical media – are non-refundable.
